The destruction wrought by Hurricane Ike in 2008 focused attention on the need for storm surge protection for the Galveston-Houston area. Researchers at Rice University found that had Ike struck slightly farther west on Galveston Island, it would have inundated scores of chemical plants and refineries. Ike would have shut down the source of 40 percent of the nation's jet fuel, 27 percent of its gasoline and 42 percent of its chemical feed stocks.

 
To protect industry and residents from another Ike, or worse, several storm-surge protection efforts are underway, including the well-known Ike Dike concept.
 
 
 
Funds from state

 
The Gulf Coast Community Protection and Recovery District, created in 2010, is on the verge of securing $3 million to $4 million from the state to complete its study, said Galveston County Judge Mark Henry, district chairman.

 
Galveston County commissioners agreed to accept the money. The other participating counties - Harris, Brazoria, Chambers, Jefferson and Orange - must approve before Henry can call a meeting to get the study underway.

 
Other efforts, meanwhile, are gaining momentum.
 
 
 
The Ike Dike concept developed by Bill Merrell, a marine sciences professor at Texas A&M Galveston, envisions a system of levees and gates spanning Galveston Island and the Bolivar Peninsula. It has the backing of eight cities in Galveston County, said Bob Mitchell, president of the Bay Area Houston Economic Partnership.

 
The partnership in March began raising the $1.5 million needed to complete studies to convince Congress that the Ike Dike is practical and can be completed in two years for $4 billion to $6 billion.
 
 
 
Mitchell said the partnership has raised about $700,000 for the studies and expects to raise the balance by July.

 
Several studies are underway, including storm modeling at Jackson State University in Jackson, Miss. Scientists at Delf University, The Netherlands, and Texas A&M Galveston are working on storm barrier design studies, Merrell said.

 
Landscape architects are working on ways to meld the storm barrier into the landscape and turn it into recreational areas.

 
Rivals no more
 
 
 
Once considered a competing proposal to the Ike Dike, a scheme by the Severe Storm Prediction, Education and Evacuation from Disasters Center, known as the SSPEED Center, at Rice University is now being put forward as complementary to its onetime rival.

 
Jim Blackburn, a center member and environmental law professor at Rice, said a storm surge gate at the Hartmann bridge can be built quickly for $1 billion to protect the chemical plants and other industry near the Houston Ship Channel.
 
 
 
"We believe it should be built rapidly and does not interfere with the project for the Ike Dike and other efforts," Blackburn said.
 
 
 
Because of a lack of local support, the center is backing off proposals for a 20-mile levee along Texas 146 to protect the Clear Lake area and a levee extending from the Galveston Seawall to encircle the city's urban core, Blackburn said.

 
Progress is also being made on a proposal by the Rice center to create the Lone Star Coastal National Recreation Area to foster a tourism-based economy that can bounce back after a storm. Houston businessman John Nau is heading the effort to gather support for the 130-mile long area spanning the coasts of Matagorda, Brazoria, Galveston and Chambers counties.

GREAT NEWS NEIGHBORS OF SUNNY SAN LEON, BACLIFF, BAYVIEW, KEMAH, SEABROOK, AND LA PORTE, TEXAS. Apparently we spoke, and they listened. If you all remember correctly, back when all this first broke around October 2012, my old buddy Dear Steve and myself got to nosing around after we got wind of this proposed seawall along SH 146 that would have been a backstop to any flood surge that came through, and would have wiped us all out east of SH 146, to make way for Recreation Areas for boating, swimming, fishing, hotels, casino’s and such, where our homes were to have once stood. The Rice dike plan even had a drawing of this area east of SH 146, showing our homes literally gone, and in place of our homes, was instead a waterfront recreational area, put into place where our homes once stood, all the while protecting the high end folks west of the railroad tracks on SH 146 and the surround Clear Lake area, just to manufacturing a high end water park for the rich to play in, on our properties. some folks call it taking ‘by eminent domain’, I call it stealing.

fantastic! thank you for your kind reply Sir, and explanation for the layperson such as me. many thanks, I like your proposal much, much, better Sir, considering my backyard is Galveston Bay here in Bacliff, 77518 shoreline. with that rice university plan, the shorelines from Kemah to San Leon and property values there from would tank and the next big one, we would all be marsh land. course, it would not matter much anyway, because that big toxic dredge island I have to look at everyday now, you know the one they propose to double in size now, well all that would be in our houses. ...what were they thinking. ...thanks again.

We Spoke, They Listened ...

 
 
 
It's a little early to pop champagne corks, but it looks like there are no longer two competing plans to protect the Galveston Bay area from massive storm surge in the next major hurricane.
 
 
 
In the aftermath of Hurricane Ike, which struck here nearly five years ago, there has been a lot of research done to find ways to minimize the damage that will occur the next time a large storm strikes.
 
 
 
Much of that research was carried out at Rice University's Severe Storm Prediction, Education and Evacuation from Disasters Center, known as the SSPEED Center.
 
 
 
The experts at Rice concluded that as bad as Ike was, it could have been much worse. According to their measurements, if the storm had struck just a couple of miles west of where it did, there would have been flooding at refineries which would have shut off over 40% of the US supplies of jet fuel and chemical feed stocks. Over one-quarter of the nations gasoline supply would have also been shut down for a significant period of time.

 
As we reported in previous issues of the Seabreeze, the experts at Rice University proposed building a dike that would have run for 20 miles down Highway 146. That proposal would have effectively sacrificed the Bayside communities to any hurricane, while protecting those west of Highway 146. The plan called for a levee- 25 feet high which would protect the Clear Lake area and League City. The study presumed that after a major storm erased the communities of San Leon, Bacliff, etc., the land where we live could be turned into a huge recreational area. Waterparks, hotels, and other commercial ventures would operate where our communities had been destroyed.
 
 
 
Of course, that idea didn't set well with the locals. There was so much anger and opposition to the idea, that Rice has now backed down from that proposal and come up with a different idea.
 
 
 
The new plan would call for building a huge storm gate at the Fred Hartmann Bridge to protect the refineries and the Port from storm surge. According to Jim Blackburn, an environmental law professor at Rice, the gate system could be built for about $1 billion. The new plan omits any mention of a dike extending down Highway 146. "We believe it should be built rapidly and does dot interfere with the project for the Ike Dike and other efforts," Blackburn said.
 
 
 
So, the Rice crew has listened to locals like Terry Singeltary (who-has given them no rest) and numerous citizens who expressed their outrage at the plan. They have abandoned the idea of letting our towns be wiped out. Mr. Singeltary and our editor, Steve Hoyland worked together to publicize the plans and rally citizens to make their voices heard.
 
 
 
The SSPEED Center and Blackburn are still pushing for a huge recreational area to be created. What they have in mind is an enormous Iand-grab that would encompass a half-million acres of coastal land. According to their final report, "A concept that emerged involved rethinking and perhaps redefining the coastal economy to capitalize on the recreational and economic value of these low-lying lands."
 
 
 
The report goes on to say that "A survey of this area revealed that some of the best bird-watching and coastal kayaking in the United States exists within the low-lying areas of the upper Texas Coast." So, the plan is to displace the existing economy and people, and replace them with bird-watchers and kayakers. Really? The eggheads are "rethinking and redefining" our coastal economy for the benefit of kayak jockeys and birds? I find that disturbing.

 
The conclusion of the SSPEED report is that "What is lacking is an institutional and governmental framework to organize the latent economic potential of these low-lying areas. As such, the SSPEED Center is proposing to create a recreational area of such importance that it would be worthy of national recognition." The proposed recreational area would take in most of Bolivar Peninsula.zhe Texas -City Prairie, and-coastal areas extending as far south as Lake Jackson and Freeport.
 
 
 
However, the good news is that the Rice group is no longer proposing to sacrifice the Bayside communities to the rain gods. There are no longer two competing plans on the table. This leaves the proposals made by Dr Merrill at Texas A&M University in Galveston. Merrill proposes using the Dutch system, which would protect the entire bay. This system has been used in New Orleans since Katrina, and uses a system of gates and barriers to keep storm surge from entering internal waters completely.
 
 
 
Merrill's proposal would include storm gates across the mouth of the ship channel and San Luis Pass that could be sealed in the event of a major storm. The Seawall would extend west on Galveston Island to San Luis Pass. On the Bolivar Peninsula, the highway would be elevated to provide a barrier all the way to Sabine Pass. Storm surge could effectively be locked out of the entire bay using this type of system.

 
The estimated total cost of creating such a system and building it is in the $6 billion range, so it won't be done without federal support. The Bay Area Houston Economic Partnership has started raising $1.5 million to complete studies to convince congress that the Ike Dike is a practical idea, and well worth the money to protect the entire region. The partnership has already raised half of that amount, and expects to reach the goal within the next several weeks.
 
 
 
The withdrawal of the Rice plan is a victory for people who live on the west side of Galveston Bay. Thanks to everyone who raised hell about it, it worked. Now let's get our politicians to get on board with the Ike Dike. (GATOR)

A big increase in a specific bacterial infection found in warm salt water has health officials on alert. The bacterium is called _Vibrio parahaemolyticus_. "It is along the whole coast of Texas," explained Dr William Burgin, Jr with the Corpus Christi-Nueces County Public Health District.


The whole coast of Texas usually sees 2-7 cases per year. In Corpus Christi, in just 3 weeks, there already have been 3 cases.


The bacterium is found in warm salt water that means you can pick it up either by swimming in infected water with an open wound or by eating the shellfish that inhabits that water.


Dr Burgin with the health department cautions that it is young people who have picked up the infection; one from eating infected food, the other 2 from being in the water.


Having cuts or scrapes will put you at a higher risk. "You never know, you may go in with no scratches, but out there in the water you step on something and that breaks the skin," Burgin explained. That's why it's important to stay aware, get out if you get cut, and do something as simple as wearing water shoes at the beach to help prevent those cuts and scrapes in the water.

It is important to stress that _Vibrio parahaemolyticus_ is naturally present in marine waters and does not imply sewage contamination, as would be the case with _Salmonella_ sp. or _E. coli_. It is most common in warmer waters such as those of the American Gulf Coast as in this case, but warmer waters in more northern climates can also be associated with oyster-associated _V. parahaemolyticus_.

"Abstract ---------


Background: _Vibrio parahaemolyticus_, the leading cause of seafood-associated gastroenteritis in the USA, typically is associated with the consumption of raw oysters gathered from warm water estuaries. We describe a recognized outbreak of _V. parahaemolyticus_ infection associated with the consumption of seafood from Alaska.


Methods: After we received reports of the occurrence of gastroenteritis on a cruise ship, we conducted a retrospective cohort study among passengers, as well as active surveillance throughout Alaska to identify additional cases, and an environmental study to identify sources of _V. parahaemolyticus_ and contributors to the outbreak.


Results: Of 189 passengers, 132 (70 percent) were interviewed; 22 of the interviewees (17 percent) met our case definition of gastroenteritis. In our multiple logistic-regression analysis, consumption of raw oysters was the only significant predictor of illness; the attack rate among people who consumed oysters was 29 percent. Active surveillance identified a total of 62 patients with gastroenteritis. _V. parahaemolyticus_ serotype O6:K18 was isolated from the majority of patients tested and from environmental samples of oysters. Patterns on pulsed-field gel electrophoresis were highly related across clinical and oyster isolates. All oysters associated with the outbreak were harvested when mean daily water temperatures exceeded 15.0 deg C (59 deg F) (the theorized threshold for the risk of _V. parahaemolyticus_ illness from the consumption of raw oysters). Since 1997, mean water temperatures in July and August at the implicated oyster farm increased 0.21 deg C per year (P less than 0.001 by linear regression); 2004 was the only year during which mean daily temperatures in July and August 2004 at the shellfish farm did not drop below 15.0 deg C (59 deg F).


Conclusions: This investigation extends by 1000 km (621 mi) the northernmost documented source of oysters that caused illness due to _V. parahaemolyticus_. Rising temperatures of ocean water seem to have contributed to one of the largest known outbreaks of _V. parahaemolyticus_ in the USA." - Mod.LL]

Report challenges state pollutant de-listing effort in Texas City


Premature To Remove Texas City From The Air Pollution Watch List

Last week, EDF, along with Air Alliance Houston (AAH), submitted comments to the Texas Commission for Environmental Quality (TCEQ) reflecting why we believe the proposed removal of Texas City for the pollutants benzene and hydrogen sulfide from the state’s Air Pollution Watch List (APWL) is premature.



The APWL is a list of areas in Texas where concentrations of harmful pollutants exceed the state’s own health-based screening level guidelines. While inclusion on the list indicates that additional scrutiny is given to permits issued to facilities in the area, some of the APWL areas have been listed for over a decade. This is significant because exposure to these toxics may impact human health and may lead to serious health outcomes, such as birth defects or cancer.



EDF has been actively engaged with TCEQ to improve management of the APWL program and to renew efforts to improve air quality in hotspot areas. TCEQ first added Texas City to the Air Pollutant Watch List in 2001 because of elevated concentrations of propionaldehyde. The organization added benzene in 2003 because the annual average concentration at the Ball Park Monitor exceeded the long-term health-based Air Monitoring Comparison Value (AMCV) of 1.0 ppb.[1] Hydrogen sulfide was then added in 2004 based on mobile and stationary monitoring data showing exceedances of the 0.08 parts per million (ppm) threshold.



TCEQ’s proposal claims that recent air monitoring information justifies the removal of Texas City from the APWL. However, new analyses completed by EDF and AAH, indicate that data from the current monitoring network are not adequate in justifying the removal of Texas City from the APWL. Here are a few reasons why:



Air monitoring information has not been correlated with wind direction, meaning that the existing monitoring network does not capture the predominant downwind concentrations of pollutants in neighborhoods closest to the largest sources. As illustrated in the insert, the largest concentration of benzene is expected in between the existing monitors. BP Texas City: The largest emitter in the area is also the worst environmental performer. BP Texas City is ranked as the largest benzene emitter in the region, not just the state. On March 23, 2005, an explosion killed 15 employees and injured 170 as a result of workers re-starting a unit at the BP refinery that had been closed for repairs. The problem started when workers filled a tank with 138 feet of flammable liquid, when it should have been filled with only 6.5 feet of liquid. Upon further investigation, it was discovered that BP had cut costs, resulting in risky working conditions, which were likely the cause of the catastrophic event. An investigation by the Chemical Safety Board found numerous problems, including out-of-date equipment, corroded pipes, and faulty safety alarms. This explosion has been characterized as one of the worst workplace incident in the U.S. between 1989 and 2005. BP Texas City II: More recently in November 2011, there were reports of gas leaks at the BP Texas City refinery. A concerned citizen initially reported a sulfur dioxide leak to the National Response Center. BP confirmed an ongoing leak of methyl mercaptan; the odor was so toxic that 30 workers from a neighboring plant downwind were taken to the hospital. Bottom line: It is too early to remove Texas City from the APWL for benzene or hydrogen sulfide. While we appreciate the efforts that the state has made in working to improve air quality in the Texas City region, there is strong evidence that residents in Texas City continue to be at higher risk for health impacts from pollutants such as benzene.



We therefore recommend that the agency place additional monitoring equipment in the areas expected to have the highest concentration of pollutants. Only properly sited monitors with validated data can justify a delisting. Without proper data collection and analysis, the TCEQ cannot ensure that it is maintaining the Air Pollutant Watch List in a manner that protects public health.

Propionaldehyde


During the 2000 and 2001 mobile monitoring projects, concentrations of propionaldehyde were detected above the odor-based air monitoring comparison value (AMCV) downwind of Dow Chemical (formerly Union Carbide). Although no odorous levels were detected in the 2004 mobile monitoring project, odorous levels were detected during the 2008 mobile monitoring project.


Benzene


Elevated benzene levels have been detected during mobile monitoring projects from 2001 to 2008, downwind of various facilities throughout the Texas City area. Some of the concentrations detected during these projects have exceeded the short-term AMCV and several detections could contribute to elevated long-term concentrations. In addition, long-term stationary monitoring in the Texas City area has historically detected annual ambient concentrations of benzene above the long-term AMCV. The 11th Street monitor, funded by Marathon, has consistently had annual average benzene concentrations above the long-term AMCV since monitoring began in 2004. Data from the 34th Street monitor, funded by BP North America Products, Inc., indicated a 70% decrease in annual average benzene concentrations from 2005 to 2008; although emission events in 2009 lead to an elevated annual average.


Hydrogen Sulfide


A 2004 mobile monitoring trip reported hydrogen sulfide (H2S) levels that exceeded the H2S 30-minute state regulatory standard. These reported levels had the potential to cause short-term odor-related health effects downwind of Gulf Coast Waste Disposal Authority (GCWDA) and Valero. A subsequent mobile monitoring project in 2008 did not detect any concentrations of H2S above the regulatory standard. Limited stationary monitoring data indicated a decreasing trend in H2S from 2004 until 2008. In 2009, however, there were 16 exceedances at the Texas City Ball Park monitor. Benzene is a carcinogenic chemical that is present in crude oil and gasoline. It is a common chemical used in various industries, however, exposure can have devastating health consequences for those who have been exposed.

Translating the Evidence about Breast Cancer Related Disparities in African American Women: A Comprehensive Community-based Program in Galveston County




Introduction: From 2003-2007, Galveston County ranked 22nd among Texas’s 254 counties in cancer mortality with 220 cancer deaths/100,000 (SEER database). The rate exceeds that of Texas (177/100,000) and the U.S. (160/100,000) and fails to meet the Healthy People 2010 Objective of 160/100,000. African American Texans annual cancer mortality is 223/100,000 compared to Non-Hispanic Whites (179/100.00) and Hispanics (130/100,000). African American breast cancer mortality in Galveston County is 34.8/100,000 compared to 26.3 and 21.2 for Non-Hispanic Whites and Hispanics. The Texas Cancer Plan reports that poverty drives disparities through lack of resources, information and knowledge; substandard living; risk promoting lifestyles; and diminished access to services. The evidence based indicates that contributors to disparities include behavioral factors (increased time to complete diagnostic workups from abnormal mammograms, more missed mammogram appointments, and unhealthy diets); environmental factors (lower socioeconomic status, higher levels of inadequate communication of abnormal mammography screening results), and genetic factors (more aggressive tumors).

I believe that if the state of Texas and the TCEQ gets this proposal through, it will go to prove that neither one care about public health, and it’s all about the almighty dollar.


since the BP deliberate upset of benzene and who knows what else for over 40 days (because after the initial upset that first day, the rest of the 39+ were deliberate), since then my wife has developed breast cancer. how many more in this area?


IF this proposal to remove Benzene, Hydrogen Sulfide, or any other pollutant into the air in the Galveston Bay area’s of Texas City, Bayport, and or any of the Houston ship channel areas, would be detrimental to this area. there is too much pollution already.


This proposals reeks of industry greed and if the oversight there from i.e. the TCEQ does not stop this from happening, then they too should hang up their jock straps as being any type of Environmental steward, and start paying their dues directly to the chemical industry they are so in bed with.

Report challenges state pollutant de-listing effort in Texas City

GALVESTON - Emissions of the pollutant benzene increased over the last three years and plumes are streaming over populated areas, according to a new report challenging an effort by state regulators to remove benzene and hydrogen sulfide from a pollutant watch list for Texas City.


The report by Air Alliance Houston and the Environmental Defense Fund identifies for the first time the source of the pollutant benzene and challenges the Texas Commission on Environmental Quality's assertion that benzene pollution is decreasing. The report also says that insufficient evidence exists to remove hydrogen sulfide from the agency's watch list.


Agency air monitors are poorly placed and failing to detect a major plume of benzene that is flowing from the Marathon refinery, purchased from BP last year, over populated areas north of the plant, the report said.


An agency spokeswoman said the report was received Friday, and the agency's response will be published on its website when it takes final action on the de-listing proposal.


"The basic premise of what we are saying is that the monitoring techniques that they are using are not adequate or appropriate," said Adrian Shelley, Air Alliance Houston executive director.


Removing the pollutants from the watch list would mean the agency would pay less attention to benzene and hydrogen sulfide levels in Texas City. The agency says that monitoring stations recorded significant emission drops for the two pollutants in 2009 and 2010.


28,000 lawsuits


The agency's own data, however, show that the pollutants increased over the last three years, although they have decreased in comparison to the levels detected in 2000, said Elena Craft, health scientist for the Environmental Defense Fund's office in Austin.


Assisted by Ram Hashomany, an Airmeasure Solutions consultant, groups analyzed the agency data to determine the primary source of benzene pollution. Hashomany, who could not be reached for comment, is assisting attorney Tony Buzbee in 28,000 lawsuits against BP for alleged health damage from a massive 2010 pollutant release from its former Texas City refinery, now owned by Marathon. "We are talking about thousands and thousands of data points and an extraordinarily clear picture emerges," Shelley said.


The data show that monitors are in the wrong place to detect benzene emissions from the Marathon refinery, he said. "It shows pretty clearly that the largest plume is going between the two monitors, and there are houses and businesses there," Shelley said.


In an email answer to questions submitted by the Houston Chronicle last month, the agency said, "These monitors are adequately sited to detect contributions from these sources under typical meteorological conditions."


Monitor placement


Shelley said that one of the monitors was placed at the edge of a wooded area where it is shielded from wind-borne pollutants. "Time and again they put them in an area that's easy to locate a monitor ... not where it necessarily captures the most emissions," Craft said.


The report also criticized the agency for combining the data from two types of monitors. "It's not scientifically accurate," Craft said. "If we want to have any assurance that these residents are not at increased risk we need to look in the areas that have the highest concentrations."


The agency is seeking to de-list benzene even though more than 538,000 pounds of pollutants poured out of the then-BP plant in 2010 after a malfunction. The release over 40 days included 17,371 pounds of benzene. The event resulted in 48,000 legal claims, including those handled by Buzbee, for damaged health from area residents.

EPA FACES LAWSUIT FOR CHRONIC UNDERCOUNTING OF TOXIC EMISSIONS

The federal Clean Air Act requires EPA to review and revise the formulas used to estimate dangerous volatile organic compounds at least once every three years. But EPA has failed to do so even after receiving a petition from the City of Houston in 2008 asking EPA to close loopholes that allow hundreds of thousands of tons of pollution to escape detection and reporting each year. The lawsuit is a follow-up action to the “notice of intent” letter filed by the groups in July 2012.


“Emissions that aren’t counted are ‘off the books’ as far as federal and state agencies are concerned,” said Whitney Ferrell, attorney for the Environmental Integrity Project, which is representing the local groups in court. “And that leaves communities downwind of oil, chemical and gas plants exposed to higher levels of butadiene, benzene, and other toxic pollutants that increase the risk of cancer and other diseases. Getting these emissions back on the radar can also help industry identify cost effective ways to recover and reuse gases that are now leaking into the air as pollution.”


Adrian Shelley, executive director, Air Alliance Houston said: "We must know what is in our air if we are going to clean it up and protect public health. We have filed this complaint as a last resort, and only because EPA has ignored repeated requests to address the problem. Seven years ago, the Agency’s own Inspector General called for overhaul of emission factors that EPA itself rated as ‘poor.’ Houston Mayor Bill White formally petitioned EPA nearly five years ago, asking the Agency to modernize the calculations that we know drastically undercount these toxic emissions. States, cities and neighborhoods trust EPA to tell the truth about the pollution from petrochemical plants; the Agency will lose that trust if it is unwilling to keep up with the science and get the data right.”


The lawsuit seeks EPA review and revision of the calculations used to measure emissions of volatile compounds from tanks, flares, and wastewater treatment systems, taking into account numerous studies over the last decade that document huge volumes of uncounted air pollution from these sources. Relatively simple actions could make a big difference – like requiring that gases sent to flares actually be hot enough to destroy the pollutants during the combustion process. Anna Hrybyk, program manager, Louisiana Bucket Brigade said: "According to industry’s own reports, refinery accidents average 5 per week in Louisiana. Fines and enforcement actions strong enough to clean up and prevent these accidents are rare because the outdated emissions factors so severely underestimate actual pollution. Over 200,000 people living within two miles of a refinery in Louisiana bear the brunt of the toxic environment created by inaccurate pollution reporting and lax enforcement."


Juan Parras, executive director, Texas Environmental Justice Advocacy Services said: “We live near hundreds of industrial facilities that release toxic and smog-causing pollutants into the air. Undercounting these volatile compounds is deadly serious for fenceline communities living in Houston’s East End to Galveston Bay that suffer from the cumulative impacts of refineries and chemical plants. EPA needs to protect public health and the environment, and there are no excuses to further delay long overdue action to revise inaccurate emission factors consistent with scientific studies.”


Hilton Kelley, executive director, Community In-Power and Development, said “For too long, the communities in Port Arthur, TX have been subjected to dangerous chemicals emitted from refineries, chemical plants, and incinerator facilities. Many of our kids suffer from asthma, bronchitis, and other air related chemical exposure illnesses. EPA should step up it's efforts to protect human health from big polluters—we depend on them for our safety.”


The lawsuit comes on the heels of EPA’s recent proposal to backpedal on a rule finalized in 2012 to control emissions of volatile compounds from oil and gas storage tanks. The original rule requires companies to install controls that will reduce toxic emissions by 95 percent from new or modified storage tanks by October 15, 2013. In response to an industry petition, EPA is now proposing to: (1) wholly exempt tanks constructed or modified in the last two years from the requirement to install controls and (2) push back compliance deadlines for all new tanks to April 15, 2014. Facilities are authorized to remove pollution controls when emissions fall below four tons per year, but the rule would allow use of outdated and inaccurate emission factors to support this claim. These changes, along with EPA’s identification of thousands of more tanks emitting high levels of volatile compounds, would allow the release of millions of tons of additional toxics, greenhouse gases, and other pollutants from storage tanks.

Refineries and chemical plants emit many hazardous pollutants, including volatile compounds like benzene, butadiene, naphthalene, acrolein, and ethylene dibromide; polycyclic organic matter; polycyclic aromatic hydrocarbons; mercury; cadmium; lead; and arsenic, among others. There is substantial scientific data demonstrating that refineries can measure their pollution with much greater accuracy than many facilities currently do. DSHS Issues Fish Consumption Advisory for Texas Coastal Waters


The Texas Department of State Health Services has issued an advisory warning people not to consume or to limit consumption of certain fish caught in all waters off the Texas coast due to unsafe levels of mercury.


Women of childbearing age, including women who are nursing, and children under 12 years old should not consume certain fish off the Texas coast. The advisory recommends women past childbearing age and adult men limit their consumption of fish from this area to no more than one or two meals per month. A meal is 8 ounces of fish. (See chart below for specific recommendations.)


The advisory was issued after testing revealed that fish examined from the northwestern Gulf of Mexico contained mercury at concentrations that exceed DSHS health guidelines of 0.7 mg/kg in the following species: shark (all species), blackfin tuna, blue marlin, little tunny, crevalle jack, king mackerel, swordfish, and wahoo. Regular or long-term consumption of these fish may result in serious adverse health effects.


Mercury is a naturally occurring element that can also be a byproduct of human activity. If consumed regularly, it can cause harmful effects to the central nervous system, particularly in children including those exposed before birth. Symptoms of prolonged exposure include liver damage, tingling of the skin, loss of coordination, visual and hearing impairment, slurred speech and other damage to the brain and nervous system.

The SSPEED Center has identified areas below 5 feet elevation as high risk and those below 25 foot as moderate risk to storm surge inundation. Most of the communities in West Bayshore lie below 25 feet msl. Given the size of the affected population in this area, the SSPEED Center is proposing that it be protected by a structural levee system. The Center has examined a series of possible levee alignments, including pocket levees built by large land-owners, a bay front levee, a levee along SH-146 and various hybrids of these alternatives.



Preliminary research results indicate that the most feasible structure will be a levee along SH-146 accompanied by pocket levees, built by private landowners. The levee would connect natural 25 foot elevations near the Houston Ship Channel and the Texas City Dike effectively protecting the properties and critical facilities and infrastructure west of SH-146. However, moveable barriers would need to be placed at Clear Lake and highway underpasses. Furthermore, this proposal leaves waterfront properties and communities east of SH- 146 vulnerable; however, it maintains the possibility of waterfront recreation and other environmental and natural coastal features.

RICE DIKE PROPOSAL WOULD DESTROY GALVESTON BAY BAYSHORE COMMUNITIES




TO FRIENDS AND NEIGHBORS IN THE BAYSHORE COMMUNITIES



THIS proposed RICE dike proposal, if approved in it’s entirety, would kill our Bay shore communities as we know it. Your property values would tank to zero, and you would eventually be forced out of your home. what the port of Houston and industries there from plan to do with this Rice dike, is to make the entire surrounding properties around the Galveston Bay complex a larger petro chemical complex, and cargo port, thus dredging more toxins for more GLIT islands to be built lining the ship channel filled with dredge toxins, for the next hurricane to bury our Bay shore communities, because the RICE DIKE, in it’s entirety, would literally wall us out of any Hurricane protective zone. What the Rice Dike does, it hangs me and my neighbors out to drown in 25 feet of water and toxic GLIT island Mud, and what is left will be used for “waterfront recreation and other environmental and natural coastal features”. This Rice dike proposal would take some of the highest elevated land around Galveston Bay and Real Estate there from, and turn it all into a marshland after the next big one.

RICE UNIVERSITY IKE DIKE hwy-146-levee proposal, THAT WOULD WASH AWAY SEABROOK, KEMAH, BAYVIEW, BACLIFF, AND SAN LEON



NOVEMBER 2011



Preliminary research results indicate that the most feasible structure will be a levee along SH-146 accompanied by pocket levees, built by private landowners. The levee would connect natural 25 foot elevations near the Houston Ship Channel and the Texas City Dike effectively protecting the properties and critical facilities and infrastructure west of SH-146. However, moveable barriers would need to be placed at Clear Lake and highway underpasses.



*** Furthermore, this proposal leaves waterfront properties and communities east of SH- 146 vulnerable; however, it maintains the possibility of waterfront recreation and other environmental and natural coastal features.
